Welcome to the Superintendent of Bankruptcy’s Trustee Licensing eConsultation

In order to maintain an efficient and effective regulatory framework, the Office of the Superintendent of Bankruptcy of Canada (OSB) is revisiting the Trustee Licensing Regulatory Framework. With the Framework currently under review, the OSB is seeking the input of stakeholders to understand the advantages and disadvantages of certain approaches.

This is an important undertaking for the OSB and your input will support a more effective and up-to-date regulatory framework.

We encourage you to share your input on any or all of the following issues under review:

• Harmonization of the Directive on Trustee Licensing with the Memorandum of Understanding between the Superintendent of Bankruptcy and CAIRP
• Dual Licensing, Specialized Licences and Administrators of Consumer Proposals
• Probationary Conditions for Newly Licensed Trustees
• Reactivation of the Licence in the Event of the Trustee’s Bankruptcy
• Corporate Names
• Closed Company (or Private Company) and Share Ownership
• Licensing Fees
• Succession Agreements
• Annual Licensing Report
• Financial Statements
• Professional Liability Insurance and Bonding

Under each topic, there are options for your consideration, along with background information and context for the specific topics. Feel free to comment on one or more topics or to respond to the opinion of others.

There are a couple of ways that you can share your views on these issues:

• By commenting on them in the discussion forum.
• By sending a formal submission to Nik Nanos from Nanos Research. These submissions will be converted to PDF and posted on the consultation site on the Direct Submission page.
